TwinStrand Biosciences announced that the U.S. District Court for the District of Delaware entered final judgment in favor of TwinStrand and the University of Washington in their patent infringement case against Guardant Health (NASDAQ:GH), awarding more than $245.2 million in damages, royalties, and interest.
The judgment follows a November 2023 jury verdict that found Guardant Health willfully infringed two patents related to TwinStrand’s Duplex Sequencing technology across 11 royalty-bearing products and services.
The court upheld the jury’s $83.4 million damages award through June 30, 2023, added $19.5 million in supplemental damages for later sales, awarded $119.4 million in accrued royalties, and included $22.9 million in interest.
TwinStrand stated that Guardant Health must pay a 6% royalty on covered products and services from June 1, 2026, through patent expiration on March 15, 2033.
The court previously denied Guardant Health’s post-trial requests to overturn the verdict or receive a new trial, while all counterclaims against TwinStrand were dismissed or withdrawn before trial.
TwinStrand Biosciences developed Duplex Sequencing technology for high-accuracy DNA sequencing applications, with patent proceedings involving the technology continuing before the U.S. Patent and Trademark Office and Patent Trial and Appeal Board.
