NIO (NYSE:NIO) confirmed that the U.S. Department of Defense has added the company to its updated list of "Chinese military companies," prompting a swift pushback from the electric vehicle manufacturer as it prepares to contest the designation.

The Shanghai-headquartered automaker stated that its inclusion on the Pentagon roster is entirely unjustified.

In an official response, NIO asserted that it does not operate as a military entity, nor does it serve as a contributor to the Chinese defense industrial base under Beijing’s military-civil fusion framework.

Crucially for public market investors, the designation does not trigger immediate financial or capital penalties.

NIO emphasized that the compilation is not an active sanctions list and does not restrict global or domestic transactions in the company's publicly traded securities.

Furthermore, the corporate leadership team indicated that corresponding U.S. government procurement limitations tied to the classification will not impact its core business operations or ongoing commercial delivery plans.

The placement on the list is part of a broader enforcement push under Section 1260H of the U.S. National Defense Authorization Act, which mandates the identification of Chinese firms deemed to have structural links to Beijing's defense establishment.

To protect corporate reputation and safeguard investor interests, NIO announced plans to proactively engage in formal dialogue with the U.S. Department of Defense.

The premium EV maker also confirmed it is prepared to pursue legal action through U.S. courts if necessary to secure an official removal from the list.
