BioMarin gains up to 20% Yuviwel royalty rights in settlement with Ascendis

BioMarin (NASDAQ:BMRN) entered into binding global settlement terms with Ascendis Pharma A/S to resolve patent disputes involving Yuviwel, including a U.S. International Trade Commission investigation and litigation in multiple countries.

The settlement follows ongoing legal disputes over BioMarin patent rights connected to Yuviwel, with Ascendis receiving continued access to market the drug under agreed royalty terms.

Under the agreement, Ascendis will pay BioMarin a 20% royalty on net Yuviwel sales in the United States and an 18% royalty on net sales in the European Union, Brazil, and South Korea through May 2030.

BioMarin said the settlement resolves all pending patent-related and related disputes.

BioMarin develops biotechnology medicines, including VOXZOGO, which uses the company’s CNP technology platform for treating certain growth disorders.

The agreement includes a license covering BioMarin patents related to Yuviwel for current and potential future indications, combination use, and other applications connected to the product.
