
Axsome settles Sunosi patent litigation, pushing generic entry to 2040
Axsome Therapeutics (NASDAQ:AXSM) has resolved all outstanding U.S. patent litigation concerning its sleep disorder medication, Sunosi, securing the drug's proprietary market positioning for nearly another two decades.
The New York-based biopharmaceutical company entered into a comprehensive settlement agreement that resolves disputes stemming from Abbreviated New Drug Application filings by generic manufacturers.
Under the negotiated terms, five generic drug companies will be permitted to introduce generic versions of solriamfetol to the U.S. market starting on or after March 1, 2040.
That launch window moves to September 1, 2040, if the drug is granted pediatric exclusivity.
The agreement marks the end of all pending Sunosi-related patent litigation for Axsome in the United States, effectively removing a layer of long-term regulatory and legal uncertainty surrounding the asset.
Commercial launch for the generic alternatives remains subject to standard conditions, including final approval from the U.S. Food and Drug Administration.
As required by federal law for antitrust monitoring in the pharmaceutical sector, Axsome will submit the final settlement agreement to the Federal Trade Commission and the Department of Justice for regulatory review.
