Trump taps Clayton despite Ripple lawsuit legacy

President Donald Trump has nominated former Securities and Exchange Commission chairman Jay Clayton to become Director of National Intelligence, reviving attention on the regulator's role in the SEC's landmark lawsuit against Ripple.

The nomination requires Senate confirmation and would see Clayton leave his current role as US Attorney for the Southern District of New York to replace acting Director of National Intelligence Bill Pulte.

“I am pleased to announce the Nomination of very Highly Respected Jay Clayton, former Chairman of the Securities and Exchange Commission… to be the next Director of National Intelligence and, importantly, to serve in my Cabinet,”

Said President Donald Trump in a Truth Social post.

Clayton remains a divisive figure among XRP supporters because the SEC filed its $1.3 billion lawsuit against Ripple on December 22, 2020, his final full day as SEC chairman.

The agency alleged Ripple conducted unregistered XRP sales, although Judge Analisa Torres later ruled that only certain institutional sales violated securities laws and imposed a $125 million penalty, far below the nearly $2 billion initially sought by regulators.

XRP traders appeared largely unmoved by the nomination, with the token rising nearly 4% on Thursday to trade around $1.13 and maintain its position among the largest cryptocurrencies by market capitalisation.

Confirmation hearings are expected to focus on Clayton's views on intelligence and national security policy, while some critics have questioned his lack of direct intelligence experience despite his extensive legal and regulatory background.

At the time of reporting, XRP price was $1.14.
