
US regulators fast-track crypto rules via interpretation
The U.S. Securities and Exchange Commission and Commodity Futures Trading Commission are accelerating crypto oversight by using interpretive rules to bypass traditional rulemaking processes.
A report from the Government Accountability Office confirmed the agencies framed the measure as an interpretation of existing law, allowing it to take effect immediately without public consultation.
“This rule provides an interpretation of the definition of ‘security’ as applied to crypto assets,”
The report stated.
By using this approach, regulators avoided the standard notice-and-comment requirements, signalling a preference for speed and clarity over lengthy legislative procedures.
The framework also suggests potential cost reductions for digital asset issuers, although the agencies did not provide a formal cost-benefit analysis to support this claim.
The GAO noted that crypto assets will be classified based on their characteristics, uses and functions, aligning them more systematically with existing securities laws.
The move highlights a broader regulatory shift towards faster policy implementation, which could reshape how crypto markets evolve under US oversight.
