Crypto groups seek faster ruling on Illinois tax law
- The Blockchain Association and Crypto Council for Innovation seek an expedited court schedule challenging Illinois’ Digital Asset Tax Act.
- The groups proposed opening summary judgment motions by 4 November 2026 and requested a February 2027 hearing.
- Illinois has agreed to pause enforcement of the law until 1 July 2027, while the legal challenge proceeds.
The Blockchain Association (BA) and Crypto Council for Innovation (CCI) have asked an Illinois court to accelerate its review of challenges to the state’s Digital Asset Tax Act.
The proposed schedule sets 4 November 2026 for opening motions, 22 January 2027 for completed briefs and February hearings.
“Illinois consumers and businesses deserve to know whether this tax is lawful before they are asked to comply with it,” Blockchain Association Chief Executive Officer Summer Mersinger said in a statement.
The proposed timetable seeks a court decision by 1 March 2027, although the judge must approve the schedule.
“While pausing enforcement of the Digital Asset Tax Act protects Illinois consumers and businesses from this onerous and legally flawed tax until July 1, it remains imperative that the merits are determined as soon as possible,” Crypto Council for Innovation Chief Executive Officer Ji Hun Kim said in a statement.
The associations argue that Illinois’ Digital Asset Tax Act unlawfully singles out digital assets for different treatment under federal and state law.
Illinois has agreed to suspend the law’s effectiveness and enforcement until 1 July 2027, protecting consumers and businesses while the dispute proceeds.
The court’s decision could determine whether Illinois can enforce its digital asset tax law under the proposed legal timetable.
