Rinehart appeals landmark ruling in royalty battle

The decade-long legal warfare over the Pilbara's iron ore riches has escalated as Gina Rinehart’s Hancock Prospecting launched a sweeping appeal against a landmark Supreme Court ruling.

The move, revealed in court documents, seeks to overturn a series of findings by Justice Jennifer Smith that would see hundreds of millions of dollars in royalties diverted to rival mining dynasties.

At the heart of the challenge is the 1655-page judgement handed down in April, which granted Wright Prospecting half of the past and future revenue from the Hope Downs 1–3 mines.

Hancock Prospecting is contesting the validity of a 1987 agreement between icons Lang Hancock and Peter Wright, asserting that the court erred in its interpretation of the entitlement.

Furthermore, the appeal targets orders requiring the disclosure of sensitive financial data intended to calculate the final debt, which Wright Prospecting estimates could reach $900 million.

The legal counter-offensive also extends to the DFD Rhodes family company. Hancock is appealing orders that granted the late Don Rhodes’ descendants partial royalties for ore produced at Hope Downs 4–7.

With legal costs already expected to exceed $100 million, the prospect of an appeals court intervention threatens to reset the clock on a saga that has already spanned 16 years.

While Justice Smith originally framed her ruling as a "50:50 split" that protected Rinehart’s ownership of the assets, the fresh appeals signal a shift from a battle over rights to an all-out war over royalties.
