The Australian Competition and Consumer Commission has launched a high-stakes enforcement investigation into allegations of anti-competitive conduct involving the nation's four primary fuel suppliers: Ampol (ASX:ALD), BP Australia, Mobil Oil Australia, and Viva Energy Australia.
The probe follows a surge of reports regarding diesel shortages impacting independent wholesalers and distributors who provide essential services to regional and rural Australia.
In a rare departure from standard protocol, ACCC Chair Gina Cass-Gottlieb publicly confirmed the investigation, citing the profound significance of fuel security during the ongoing Middle Eastern conflict.
"The ACCC is closely scrutinising all fuel markets during this period," Cass-Gottlieb stated, noting that the watchdog is treating the matter with extreme urgency.
The investigation aims to determine whether the major players have engaged in behaviour that unfairly stifles competition or restricts supply to smaller competitors.
The timing of the probe is critical, as Australian farmers, businesses, and consumers face mounting pressure from volatile global pricing and supply chain disruptions.
While the ACCC remains in the preliminary stages of its inquiry and has not yet reached a formal conclusion regarding the suppliers' conduct, the regulator has issued a stern warning to the industry.
Cass-Gottlieb emphasised that the commission would not hesitate to act swiftly to enforce competition and consumer laws if breaches are identified.
