
US prosecutors oppose Mashinsky bid to vacate sentence

US prosecutors urged a federal court to reject former Celsius CEO Alex Mashinsky’s request to vacate his 12-year sentence.
Mashinsky filed the request after choosing to represent himself in court, known as proceeding pro se.
Prosecutors said Mashinsky’s petition repeats arguments about Celsius and challenges evidence presented at his sentencing.
Prosecutors also said Mashinsky had not submitted a sworn declaration supporting his allegations and asked the court to deny his petition.
Mashinsky was sentenced to 144 months in May 2025 after pleading guilty to commodities fraud and securities fraud.
He was also ordered to pay $48 million in forfeiture and agreed to pay $10 million under a separate Federal Trade Commission settlement.
The case follows Celsius’ 2022 bankruptcy, while a separate Securities and Exchange Commission case against Mashinsky remained unresolved as of July 2026.
