Uphold to pay $5M in NY crypto settlement

New York Attorney General’s Office has secured more than $5 million in compensation from Uphold HQ Inc. for customers affected by the CredEarn crypto product.

The settlement relates to Uphold’s offering of CredEarn, a third-party investment product from Cred LLC, which generated returns through high-risk lending while being presented to users as a savings-style product.

Regulators found that customers were misled about the nature of risks and protections, including claims of insurance that did not cover investor losses.

“Investors should be able to trust the industry advice they receive, and my office will always work to ensure bad actors are held accountable for endangering their customers’ financial security,”

Said New York Attorney General, Letitia James.

Uphold must now enhance due diligence processes, register as a broker with state authorities, and ensure stronger oversight of third-party products offered through its platform.

The company is also required to distribute any funds recovered from Cred’s bankruptcy proceedings to affected users, with at least $5 million earmarked for repayment.

The case forms part of a broader enforcement push by New York regulators, which has secured over $2.5 billion in restitution and penalties across multiple crypto-related actions.
