Illinois agrees to delay digital asset tax

  • Illinois officials and industry groups jointly seek to delay the Digital Asset Tax until July 1, 2027.
  • The 0.2% tax was originally scheduled to take effect on January 1, 2027.
  • The delay would allow the court to consider constitutional challenges before enforcement begins.

Illinois officials and industry groups have agreed to seek a six-month delay for the Digital Asset Tax.

The proposed delay would move enforcement from January 1, 2027, to July 1, 2027.

The parties said the delay would allow orderly briefing and adjudication of the underlying legal questions.

The Chamber of Digital Commerce and Illinois Blockchain Association challenge the law’s constitutionality.

The amended complaint alleges violations involving Illinois tax rules, due process and federal commerce protections.

Illinois officials dispute those allegations but agreed that the legal issues should be resolved before enforcement.

The parties also agreed to extend the defendants’ deadline for responding to November 13, 2026.

The initiative marks a temporary shift in Illinois digital asset tax enforcement while the court reviews the dispute.
