France’s Council of State has rejected an emergency request to suspend the decree implementing DAC8 crypto reporting rules.

The request was filed by Paymium, Leonod and Satoshi Portal over concerns about crypto user data collection.

The court found that the applicants had not established sufficient urgency to suspend the decree before the main case.

The companies argued that centralising user identities and transaction data could increase the risk of damaging data leaks.

The court said the potential privacy impact did not establish enough urgency, given the public interest in preventing tax fraud and evasion.

The ruling did not decide whether the decree itself is legally valid, leaving the applicants’ separate annulment challenge active.

DAC8 requires crypto service providers to collect and report information on transactions involving EU-resident users, with the first reporting covering 2026 activity.
