CFTC secures $31 million Fundsz fraud judgment

The Commodity Futures Trading Commission (CFTC) has secured a default judgment against two Fundsz defendants.

Brian Early and Alisha Ann Kingrey must pay more than $31 million under the court order.

The judgment includes $15.73 million in restitution and a $15.75 million civil monetary penalty.

The court found both defendants made material misrepresentations about Fundsz profits and trading performance.

They also falsely represented that participants' funds would follow a proprietary algorithm.

The court found participants were told their funds could be withdrawn after 180 days with interest.

The case also involved Fundsz founder Rene Larralde and Juan Pablo Valcarce, who faced separate consent orders.

The court permanently barred Early and Kingrey from further Commodity Exchange Act violations, registration and trading.
