- Bitpanda was fined €70,000 by Austria’s financial regulator for breaching MiCA rules.
- The penalty is the regulator’s first published final fine under the EU crypto law.
- The breaches involved a late white paper and missing disclosures in marketing material.
Bitpanda was fined €70,000 by Austria’s Financial Market Authority for breaching EU MiCA rules.
The fine is the FMA’s first published final penalty under the Markets in Crypto-Assets Regulation.
The FMA said Bitpanda failed to submit a crypto-asset white paper at least 20 working days before publication.
Bitpanda also distributed marketing material before publishing the required white paper, according to the regulator.
The FMA also found missing disclosures and contact details in another marketing communication, while Bitpanda said it fixed the issues.
Bitpanda said the breaches involved timing and formal requirements, and that customer funds and platform security were not affected.
The penalty decision is final, while MiCA sets common rules for crypto companies across the European Union.
